These terms are an agreement between you and RetiredInfoGeek, LLC (“we”) for the use of the Do I Snore app (the “App”). By installing or using the App you accept them. Apple’s standard End User License Agreement also applies to apps from the App Store; where it conflicts with these terms, Apple’s terms govern as between you and Apple.
The App
Do I Snore records short audio clips at random times while you sleep and lets you review them in the morning. Recordings are stored on your iPhone only (see the Privacy Policy). You are responsible for keeping copies of anything you don’t want to lose; the “Stitch into one recording” feature and the Files app are there for that purpose.
Price
The App is free. It has no subscriptions, in-app purchases or advertisements.
Not medical advice
The App is not a medical device and is not intended to diagnose, treat, cure or prevent any condition, including sleep apnoea. The loudness readings are measurements of sound at the microphone and depend on where the phone is, the room, and anything else that makes noise. Do not rely on the App for health decisions. If you have concerns about your sleep or breathing, see a doctor.
Recording other people
The App records whatever the microphone can hear, including other people in the room. You are responsible for obtaining any consent and for complying with the recording and privacy laws that apply where you are. Do not use the App to record anyone without their knowledge where that is unlawful.
What the App needs from your phone
The App needs microphone permission to work, keeps the microphone open while a night is running so that iOS allows it to continue with the screen locked, and uses storage space for the clips (shown in Settings). It uses more battery than an idle phone; we recommend plugging the phone in. Recording may be cut short or stopped by phone calls, alarms, low power, other apps taking over the microphone, or iOS itself, and we cannot guarantee that every night will be recorded in full.
Acceptable use
Use the App for its intended purpose and in accordance with Apple’s terms and the law.
Disclaimer and liability
The App is provided “as is”. We don’t guarantee it will be error-free, that it will record on any particular night, or that it will suit a particular purpose. To the extent permitted by law, we are not liable for lost recordings, battery use, storage use, or any loss arising from the use of or reliance on the App, and our total liability to you for any claim relating to the App is limited to the amount you paid for it, which is nothing.
Changes to these terms
We may update these terms. The date above changes when we do, and material changes will be noted in the App’s release notes. Continuing to use the App after a change means you accept it.
